What Is a Penal Code 1275.1 Hold?

California Penal Code § 1275.1 addresses situations in which a court has reason to believe that some portion of the money, property, pledge, security, deposit, or indemnification offered for bail may have been obtained through felony activity.

When a PC 1275.1 hold is placed, the jail generally cannot release the defendant simply because someone is ready to post bail. The court must first determine whether the proposed source of bail is lawful.

Can a Bail Bond Be Posted While the Hold Is Active?

Generally, a defendant cannot be released through a bail bond until the court has addressed the PC 1275.1 hold.

A bail company can begin reviewing the bond, communicating with the family, identifying the proposed indemnitors and discussing potential collateral. However, the bond should not be posted until the hold has been cleared or the court has issued an order permitting the defendant’s release.

Jason is amazing he makes the process super simple. He's nice and goes above and beyond and it seems like he really cares for his clients. I totally recommend going thru Two Trees. He's very prompt my spouse had called around multiple places and he had the paperwork done and had a release within just a few hours! He didn't ask for a cosigner or for any collateral and did it on good faith which nobody else we called did they all wanted a cosigner. Our credit isn't good from past bills so it was a major relief. We overslept our alarm and he went down to the courthouse for us to check the calendar+which was awesome cuz he didn't have to do that 💕I highly recommend I wouldn't go thru anyone else to be honest! We met Jason by chance at the detention facility and he offered to let me use his phone because we had already taken our phones back to the car. We had no idea he was a bailbondsman.
